In short
- Borrowing: at Nebraska's median home value, a hypothetical line is about $78,480 (math below).
- State tax: none found. Deeds securing a debt are exempt from Nebraska's documentary stamp tax.
- Signing: both spouses must sign and acknowledge a mortgage on a married person's homestead.
How much you could borrow in Nebraska
A HELOC limit starts with your home's value, the share of it a program will lend against in total, and what you already owe. Here's the math using Nebraska's median owner-occupied home value from the U.S. Census Bureau's American Community Survey (2024).
Hypothetical math, not a quote. The 80% combined loan-to-value (CLTV) is an assumption; the maximum depends on the program, your credit and the property, and income and debts can lower the line further. Run your own numbers in the HELOC calculator.
Nebraska recording costs on a HELOC
We found no Nebraska tax on recording a mortgage. The documentary stamp tax applies to deeds that transfer real estate, and deeds that secure a debt are exempt (Neb. Rev. Stat. § 76-902). Recording fees and lender and third-party costs are separate.
Who has to sign
The homestead of a married person can't be encumbered unless both spouses sign and acknowledge the mortgage or deed of trust (Neb. Rev. Stat. § 40-104). Acknowledging means signing before a notary, so plan for both of you to be at closing or to sign with a notary. Nebraska is not a community property state.
Federal rules that apply in every state
- You get a three-business-day right to cancel a HELOC on your principal home. See where to find your terms.
- A variable-rate HELOC can change only with a public index outside the lender's control, and it must have a lifetime rate cap. See how HELOC rates are set.
- Your lender must give you HELOC disclosures and the CFPB's HELOC booklet when you apply.

Frequently asked questions
How much can I borrow with a HELOC in Nebraska?
It depends on your home's value, what you owe and the program's maximum combined loan-to-value. At Nebraska's median owner-occupied value of $263,100 (2024 Census estimate), an 80% CLTV and $132,000 owed, the line would be about $78,480. That's hypothetical math, not a quote.
Is there a mortgage tax on a HELOC in Nebraska?
We found none. Nebraska's documentary stamp tax exempts deeds that secure a debt (Neb. Rev. Stat. § 76-902). You'll still pay recording and other closing costs.
Does my spouse have to sign a HELOC in Nebraska?
Yes, if it's your homestead. Neb. Rev. Stat. § 40-104 requires both spouses to sign and acknowledge any instrument encumbering a married person's homestead.
