In short

  • Borrowing: at Virginia's median home value, a hypothetical line is about $120,800 (math below).
  • State tax: yes. 25 cents per $100 of the maximum line, plus a possible local one-third.
  • Signing: dower and curtesy are abolished. Co-owners sign; ask about a spouse who isn't on title.

How much you could borrow in Virginia

A HELOC limit starts with your home's value, the share of it a program will lend against in total, and what you already owe. Here's the math using Virginia's median owner-occupied home value from the U.S. Census Bureau's American Community Survey (2024).

Home value × maximum CLTV − mortgage balance = largest possible lineHypothetical: $403,500 × 80% − $202,000 owed (about half the value) = $120,800

Hypothetical math, not a quote. The 80% combined loan-to-value (CLTV) is an assumption; the maximum depends on the program, your credit and the property, and income and debts can lower the line further. Run your own numbers in the HELOC calculator.

Virginia's recordation tax on a HELOC

Virginia charges a state recordation tax on deeds of trust and mortgages of 25 cents per $100 of debt (Va. Code § 58.1-803). For a revolving or credit-line deed of trust, it's based on the maximum amount that may be outstanding at any one time, not the balance at closing. Cities and counties may add a local tax equal to one-third of the state tax (§ 58.1-814), which would bring the total to about 33 cents per $100 where it's adopted.

Maximum line × $0.25 per $100 = Virginia state recordation taxExample: a $100,000 line = $250 state tax, plus up to about $83 if your locality adds its one-third

Two rules can lower the bill. Refinancing an existing debt on which Virginia tax was already paid is taxed at 18 cents per $100 (§ 58.1-803(E)). And when a deed of trust is modified, such as raising a HELOC limit, tax is due only on the increase (§ 58.1-803(D)).

Who has to sign

Virginia is not a community property state, and it abolished dower and curtesy, the old spousal rights that once made a spouse's signature necessary (Va. Code § 64.2-301). We didn't confirm a statute requiring a spouse who isn't on the title to sign, so who signs depends on how the home is titled and on the lender's and title company's requirements. If you and your spouse own the home together, expect both of you to sign.

Federal rules that apply in every state

  • You get a three-business-day right to cancel a HELOC on your principal home. See where to find your terms.
  • A variable-rate HELOC can change only with a public index outside the lender's control, and it must have a lifetime rate cap. See how HELOC rates are set.
  • Your lender must give you HELOC disclosures and the CFPB's HELOC booklet when you apply.

Frequently asked questions

How much can I borrow with a HELOC in Virginia?

It depends on your home's value, what you owe and the program's maximum combined loan-to-value. At Virginia's median owner-occupied value of $403,500 (2024 Census estimate), an 80% CLTV and $202,000 owed, the line would be about $120,800. That's hypothetical math, not a quote.

Is there a recordation tax on a HELOC in Virginia?

Yes. Virginia's state recordation tax is 25 cents per $100, based on the maximum amount of the line, and localities may add one-third more (Va. Code §§ 58.1-803, 58.1-814). On a $100,000 line that's $250 in state tax.

Does my spouse have to sign a HELOC in Virginia?

If your spouse is on the title, yes. We didn't find a Virginia statute requiring a spouse who isn't on the title to sign, so it depends on how the home is titled and on the lender's requirements. Ask before closing.
